Bequall (“we”, “us”, or “our”) is committed to respecting your privacy. This privacy policy (the “Policy”) covers Bequall owned and operated websites (“Site”) and any products or services offered by Bequall (collectively, the “Services.”) This Privacy Policy is incorporated into, and is part of, our Terms of Use which govern your access to and use of the Site and Services. Unless otherwise defined herein, capitalized terms shall have the meaning assigned to such terms in the Terms of Use.

The Policy describes the types of information we gather from people visiting our Site and from individual users (“you” or “users”) interacting with the Services, and how we use, transfer, and secure such information. By accessing our Site or using any of the Services, you agree to be bound by this Policy.  This Policy does not govern information we receive from third parties, such as from public sources and our third party vendors, and does not apply to information that you provide directly to third parties. 

If you do not agree to the terms of this Policy, please do not use the Site, or any of our Services. Each time you use the Site or Services, the current version of this Policy will apply. Information We Collect and How We Use It 

We collect two types of information from users of our Site and Services: “Personal Information,” which is information that you provide that can be used to identify you (such your name or email address), and “Aggregate Information,” which is information that cannot be used to identify you (such as frequency of visits to the Site, your browser type, etc.)

Personal Information Collected

We collect Personal Information that you voluntarily provide to us when you use our Site and Services.  For example, you may provide us with your email address, first name and last name, phone number, job title, physical address, or other Personal Information when you choose to submit such information to us through email, an online form or other method (such as contacting us through our “Get Involved” or “Careers” Site features). We also collect customer and contractor referrals and information from our customers and their contractors and vendors.

If we have collected your Personal Information through our Site or Services, or through other channels, we may use it to have one of our representatives contact you about our products and services, inform you about and gather your feedback about our Site and Services, other products and services and our business. We may also use your information for internal analysis. You may unsubscribe from any marketing communications at any time by selecting the opt-out link which will be contained in any such email or communications that you receive, or by contacting us by using the details below. Please note, however, that if you have a business relationship with us, you will not be able to opt-out from receiving communications from us concerning our business relationship.

Information Collected From Our Housing Solutions and Services Customers

In addition to the Personal Information we generally collect from users of our Services, we also collect certain additional Personal Information and other project-related information from our housing solutions customers. This may include contact information, site information, project information, transaction history, payment card information and other financial data, etc. We receive this information directly from our customers, as well as from their service providers, consultants, architects, contractors, and other third parties. We use this information to provide our housing solutions products and services, the Services, and to inform our customers about our products and services, and our business. In addition, our payment processors generally provide us with some limited information related to you, such as a unique token that enables you to make additional purchases using the information they’ve stored, including recurring payments if you become a subscriber, and your card’s type, expiration date, and certain digits of your card number.

Website Visitors

We may maintain a log of certain information concerning visitors to our Site, including but not limited to, a visitor’s IP address (a computer’s numerical Internet address), the websites from which visitors access our Site, the type of web browsers used to access our Site, the device used to access our Site, and the pages viewed. Such information may be treated as Personal Information under certain applicable local laws. We only use this type of information to understand how our Site is accessed and how it is used.

Employment

If we have collected your Personal Information through our “Careers” page in response to a job opening, you are giving us permission to process and retain your information for the purpose of evaluating your application for employment consideration for the specific position that you applied to, as well as other roles at Bequall. This Personal Information may be processed and stored by a third party talent tracking solution provider.

Collection of Personal Information by Third Parties

Some links on our Site may redirect you to third party websites that we do not operate. The privacy practices of those websites will be governed by their own policies. We make no representation or warranty as to the privacy practices or policies of any third parties, including the providers of third party applications. If you are submitting information to any such third party through our Site, you should review and understand that party’s applicable policies, including their privacy policies, before providing your information to the third party.

Aggregate Information Collected

Aggregate Information is information that does not identify you. Aggregate Information may be collected when you visit our Site, independent of any information you voluntarily enter. Additionally, we may use one or more processes to de-identify information that contains Personal Information, such that only Aggregate Information remains. We may collect, use, store, share, and transfer Aggregate Information without restriction.

For example, when you visit our Site, some information may automatically be collected. Such information could include your operating system, the site from which you linked to us (“referring page”), the name of the website you choose to visit immediately after ours (called the “exit page”), information about other websites you have recently visited, browser (software used to browse the internet) type and language, device identifier numbers, your site activity, and the time and date of your visit. Although we do our best to honor the privacy preferences of our visitors, we are not able to respond to Do Not Track signals from your browser.

Use of “Cookies”

Like most websites, our Site may use “cookies.” Cookies are alphanumeric identifiers that we transfer to your computer’s hard drive through your web browser to help us identify you when you come to our Site.  You have choices with respect to cookies. By modifying your browser preferences, you have the choice to accept all cookies, to be notified when a cookie is set, or to reject all cookies. Third-Party Analytics

We may partner with certain third parties to to engage in analytics, auditing, research, and reporting. These third parties may use web logs, pixel tags, or other technologies, and they may set and access cookies on your computer or other device.

In particular, our Site may use Google Analytics, Mixpanel, and Hubspot to help collect and analyze certain information for the purposes discussed above.

Sharing of Personal Information with Third Parties

We may transfer Personal Information to third parties for the purpose of providing the Site and Services, operating our business, or with your consent.  For example, we may transfer your Personal Information to third party service providers to assist with providing the Site and our Services, and to communicate with you about current or future offerings.

In addition, we may transfer and share Personal Information and other information of customers of our Services, including our housing solutions and services, with consultants and contractors, project managers, government and municipal officials, and payment processors ] in connection with providing the Services and projects related thereto, and to process your payments. Where possible, we enter into written confidentiality agreements with such third parties. Bequall does not sell, trade or otherwise share Personal Information with third parties for the marketing purposes of the third party.

We may also transfer your Personal Information to third parties under the following circumstances: (i) to comply with a legal requirement, judicial proceeding, court order, or legal process; (ii) to investigate a possible crime, such as fraud or identity theft; (iii) in connection with the sale, purchase, merger, reorganization, liquidation or dissolution of Bequall; (iv) when we believe it is necessary to protect the rights, property, or safety of Bequall or other persons, or (v) as otherwise required or permitted by law, including any contractual obligations of Bequall.

Third-Party Links, Websites, Apps, and Communication Technologies

Our Site and Services may contain links to and from websites and apps of other third parties and may include social media features such as Facebook, Twitter and LinkedIn buttons or links. These third-party sites and apps may collect information about you if you click on a link and the social media sites may automatically record information about your browsing behavior every time you visit a site that has a social media button. Your interactions with these features are governed by the privacy policy of the company providing the link, not this privacy policy. A link to any third-party site does not imply that we endorse or accept any responsibility for the content or use of such site. We encourage our users to be aware when they leave the Site or Services and to read the privacy policies applicable to such third-party websites and apps.

Access/Corrections/Information Removal/Opt-Out

You can request that any Personal Information stored by us be deleted at any time by contacting us at contact@bequall.com. We may require you to provide certain information to verify that it is you making the request. However, note we will not delete information that we are required to retain in order to comply with applicable laws and regulations, nor will we delete information that is necessary in order for us to complete a transaction with you. If you no longer wish to receive our marketing and promotional communications, you may opt-out by following the instructions included in each communication.

Children and Privacy

Our Site is not intended to be used by children under the age of 13, and we do not knowingly collect Personal Information from children under the age of 13 in connection with the Site.

How We Protect Your Information

We take the security of your Personal Information very seriously. We use reasonable administrative, physical, and technical safeguards to secure the Personal Information you share with us. Despite these safeguards and our additional efforts to secure your information, we cannot promise or guarantee that hackers, cybercriminals, or other unauthorized third-parties will not be able to defeat our security and improperly collect, access, steal, or modify your Personal Information.

Each time you use our Site the current version of this Policy will apply. When you use our Site, you should check the date of this Policy (which appears at the bottom of the Policy) and review any changes since the last version. Our business changes frequently and this Policy is subject to change from time to time.

If you decide to use our Site or Services, or share your Personal Information with us, you are agreeing to be governed by the laws of the United States as appropriate, and you are expressly consenting to the transfer of your Personal Information to the United States.

Governing Law

This Policy is governed by the laws of the Commonwealth of Massachusetts, U.S.A. without giving effect to any principles of conflict of law.

Notice to Nevada Residents

Nevada residents can opt out of the sale of their personal information. We do not sell personal information today, and we do not have plans to sell personal information in the future. However, Nevada residents have the legal right to opt out of the sale of their personal information, even if their information is not currently being sold. You may opt out by emailing a request to contact@bequall.com. In your request, please specify that you wish to “Opt-out of Sale of Personal Information in Nevada.” Please allow 60 days for a response.
